ACKNOWLEDGMENT OF AGREEMENT & VOLUNTARY EXECUTION

I HAVE READ THIS AGREEMENT CAREFULLY AND FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT BY SIGNING THIS AGREEMENT, I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS. I ACKNOWLEDGE THAT I AM SIGNING THIS AGREEMENT FREELY AND VOLUNTARILY, WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE OF ANY KIND, AND THAT I INTEND THIS AGREEMENT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW.

PARENT OR LEGAL GUARDIAN LIABILITY WAIVER (MINORS)

If the Participant is under the age of eighteen (18), I represent and warrant that I am the parent or legal guardian of the minor participant (the “Minor”), or that I am otherwise legally authorized to execute this Agreement on the Minor’s behalf.

I agree to be legally bound by all terms of this Agreement on behalf of myself and the Minor, including all releases, waivers, assumptions of risk, and indemnification obligations. I further agree to defend, indemnify, and hold harmless Reliant Sentinel Training Solutions, LLC and the Released and Indemnified Parties from any and all claims, demands, actions, damages, or liabilities that the Minor may assert now or in the future arising out of or related to the Minor’s use of rented equipment or participation in any associated activities.

If it is later determined that I did not have legal authority to sign this Agreement on behalf of the Minor, I nevertheless agree to personally assume full responsibility and to defend and indemnify the Released and Indemnified Parties from any claims arising from the Minor’s participation or use of the equipment.

NO CONTROL OF VENUE OR THIRD-PARTY ACTIVITIES

I understand and acknowledge that Reliant Sentinel Training Solutions, LLC is a rental equipment provider only and does not own, operate, control, manage, supervise, or maintain any facility, premises, field, arena, or location where rented equipment may be used.

I acknowledge that any location at which equipment is used may be owned or operated by a third party, and that Reliant Sentinel Training Solutions, LLC has no control over site conditions, rules, participants, lighting, terrain, structures, or activities conducted at such locations.

I expressly assume all risks associated with the use of rented equipment at any third-party or customer-selected location.

ELECTRONIC SIGNATURE & ENFORCEABILITY

I acknowledge and agree that this Agreement is executed electronically in accordance with Utah Code Ann. § 46-4-201, and that this electronic Agreement is valid, binding, and enforceable to the same extent as a handwritten signature on a physical document.

I expressly consent to the use of electronic records and electronic signatures and waive any right to challenge the validity or enforceability of this Agreement on the basis that it was executed electronically or exists in electronic form.

JURY TRIAL WAIVER

I knowingly and voluntarily waive any right to a trial by jury in any action or proceeding arising out of or relating to this Agreement, the rental, issuance, possession, transport, or use of equipment, or any injury, loss, or damage allegedly sustained in connection therewith. I acknowledge that this waiver is made for the express purpose of efficient and predictable resolution of disputes.

OPTIONAL 30-MINUTE EQUIPMENT ORIENTATION & VOLUNTARY ACCEPTANCE

Reliant Sentinel Training Solutions, LLC may offer an optional, non-mandatory equipment orientation of up to thirty (30) minutes with each rental, upon request. This orientation is limited solely to basic equipment handling, mounting, operational overview, and general safety considerations related to the rented equipment.

The orientation is provided as a courtesy to assist renters in understanding the equipment and to help mitigate the risk of misuse. It does not constitute training, instruction, supervision, or direction of any activity, game, scenario, or event in which the equipment may be used.

Voluntary Acceptance

I acknowledge that participation in the optional 30-minute equipment orientation is entirely voluntary. I understand that I may accept or decline the orientation at my discretion, and that declining the orientation does not restrict my ability to rent equipment or alter my responsibilities under this Agreement.

I further acknowledge that participation in the orientation does not eliminate or reduce the risks associated with the use of night-vision or thermal equipment, and that no guarantee is made regarding safety, performance, or outcomes as a result of participation.

Whether I accept or decline the optional orientation, I remain fully responsible for the equipment and fully assume all risks associated with its use.
